Dear Mr. Heyl:

This letter will confirm recent telephone conversations between our offices in which it was mutually agreed to grant the NJDEP an additional 30 days pursuant to 15 CFR 930.60(a)(3),

until August 22, 2005, for the sole purpose of completing its review of the data and information already submitted in support of our consistency certification.

Reference 1 requested concurrence from the State of New Jersey with AmerGen Energy Company, LLC's (AmerGen's) Federal Consistency Determination for Federal Permit and License Applicants.

In Reference 2 the State of New Jersey requested necessary data and information to aid the State of New Jersey in their review of Reference 1. In addition, it was stated that a decision on AmerGen's request was due on or before July 21, 2005.

In Reference 3 AmerGen supplied the data and information to the State of New Jersey that was requested in Reference 2.

NJ DEP, Land Use Regulation Program July 20, 2005 Page 2 Subsequent conversations with the State of New Jersey revealed that additional time beyond the July 21, 2005 required response date is needed to aid in their review process based on the data and information provided by AmerGen. It is not anticipated that any additional information would be required for the State to reach its determination. A mutually agreeable extension was agreed to such that a decision from the State of New Jersey would be due on or before August 22, 2005.

After your office completes their reviews, AmerGen requests a letter concurring with the previously transmitted Federal Consistency Certification for Federal Permit and License Applicants.
