Dear Mr. Gurdziel:

This letter responds to your letter dated June 12, 2005. I want to express my appreciation for your informing me of a potential nuclear safety issue at the Nine Mile Point Nuclear Station.

Constellation Energy has emphasized the importance of taking timely and effective corrective actions for equipment failures at each of its facilities, including Nine Mile Point. More specific to a concern cited in your letter, we have completed installation of redundant UPS inverters to provide defense in depth for the UPS 2B inverter. Additionally, we have implemented a similar modification to the UPS 2A train, even though that power supply has not exhibited repeat failures. Equipment performance and reliability at Nine Mile Point have improved since Constellation Energy acquired the units. This improvement is reflected in internal indicators maintained by Constellation Energy and external indicators maintained by the NRC and INPO.

With regard to staffing levels at Nine Mile Point, the nuclear industry has shown that carefully planned and controlled complement reductions can be performed with no adverse impact on nuclear safety. Constellation Energy has been successful in strategically optimizing the site staffing, consistent with industry trends, while maintaining or improving plant safety and reliability. Many of these changes are the result of process improvements. I am confident that our staffing levels, combined with our equipment reliability initiatives, will support the license extension efforts at Nine Mile Point.
