SUBJECT:

RENEWAL OF FULL-POWER OPERATING LICENSE FOR ARKANSAS NUCLEAR ONE, UNIT 2 This memorandum informs the Commission of the issuance of a renewed facility operating license for Arkansas Nuclear One, Unit 2 (ANO-2). By letter dated October 14, 2003, Entergy Operations, Inc., submitted an application to renew the operating license for ANO-2. The staff reviewed the license renewal application in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Parts 51 and 54. Region IV also performed inspections, as described in a May 15, 2005, memorandum from Bruce Mallett, Regional Administrator to James E. Dyer, Director, Office of Nuclear Reactor Regulation. The staff documented the results of its safety review in its uSafety Evaluation Report Related to the License Renewal of the Arkansas Nuclear One, Unit 2," which was published as NUREG-1 828 in June 2005.

With respect to environmental matters, the staff documented the results of its reviews in a supplemental environmental impact statement published as NUREG-1437, "Generic Environmental Impact Statement for License Renewal of Nuclear Plants, Supplement 19,

  • Regarding Arkansas Nuclear One, Unit 2," dated April 2005.

Pursuant to the Commission's June 5, 2002, staff requirements memorandum, SECY-02-0088, the Director of the Office of Nuclear Reactor Regulation issued Renewed Facility Operating License No. NPF-6 for Arkansas Nuclear One, Unit 2, on June 30, 2005. The staff completed the final action within 22 months meeting the agency's goal for reviewing a license renewal application that is not subject to a hearing.

2 The staff currently informs the Commission of license renewals via memoranda and the EDO Daily Notes. In the interest of efficiency, the staff proposes to discontinue issuing memoranda and to utilize the EDO Daily Notes as the vehicle for informing the Commission of the issuance of renewed operating licenses.

Chairman Diaz's Comments on COMSECY-05-0025 I approve the staff's proposal in COMSECY-05-0025, "Renewal of Full-Power Operating License for Arkansas Nuclear One, Unit 2," to discontinue issuing memoranda and instead utilize EDO Daily Notes as the vehicle for informing the Commission of the issuance of renewed operating licenses. However, I also recommend that the staff provide written notice, to the Commission or Commission offices, at least three days in advance of the intended issuance of a renewed operating license.

The staff should also continue to keep the Commission offices fully and currently informed of significant issues in the area of license renewal, subject to separation of functions rules when applicable. The staff should continue to decide the appropriate vehicle for such communications on a case-by-case basis.

I believe the staff has done a commendable job of keeping the Commission offices informed of license renewal issues through various communications means. Two recent examples include the issues the staff encountered during the reviews of the license renewal applications for Nine Mile Point Units 1 and 2 and Beaver Valley Units 1 and 2.

Commissioner Merrifield's Comments on COMSECY-05-0025 I disapprove of the staff's request. Currently, both the memorandum and the EDO Daily Notes inform the Commission of nuclear power plant license renewals after they have occurred. This does not meet my expectation of fully and currently informed. In my view, it would be more beneficial to be informed by memorandum at least three days prior to the issuance of the license renewal action.
