SUBJECT:
KEWAUNEE POWER STATION - EXTENSION REQUEST FOR 2005 MATERIAL STATUS REPORTS (TAC NO. MC7185)
Dear Mr. Gaffney:
By letter dated May 20, 2005 (ML051510188), Nuclear Management Company, LLC (the former licensee), requested an extension to the due date for the 2005 Material Status Reports from May 20 to June 30, 2005. The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your request and concludes that approving the time extension for submitting the material status reports is warranted, and will not reduce the effectiveness of your security and safeguards programs. The staff's evaluation is enclosed. The evaluation contains proprietary information in accordance with 10 CFR 2.390(d).
The NRC staff noted that the time for submitting the material status reports elapsed on May 20, 2005, and that you requested the extension on that date, leaving you in non-compliance with the reporting requirements of 10 CFR 74.13(a). The staff expects licensees to submit requests for extension in a timely manner to allow evaluation and response before the required reporting date. Please take appropriate corrective actions to ensure that you comply with the reporting requirements in the future.
If you have any questions regarding this matter, please call me at (301) 415-2296.
Sincerely,
/RA/
