SUMMARY

OF MARCH 17, 2005, MEETING TO DISCUSS TORNADO MITIGATION STRATEGY On March 17, 2005, the Nuclear Regulatory Commission (NRC) met with Duke Energy Corporation (the licensee) to discuss the Oconee tornado mitigation strategy. Attachment 1 provides a list of the attendees. Attachment 2 contains the slides presented by the licensee.

The licensee stated its position is that Oconee is in compliance with its licensing basis with respect to tornado mitigation, although the licensee recognizes that the NRC staff continues to question this position. The NRC staff stated that the Unit 3 control room wall constitutes a specific example of a failure to comply with the Oconee licensing basis. The licensee is planning to submit a license amendment request (LAR) for the Unit 3 control room wall that uses the TORMIS code to evaluate missile strike probability. The NRC staff stated that this evaluation should consider the overall site vulnerability to missiles, consistent with the approved topical report for the evaluation method.

The licensee performed a safety review of each of the items identified by the NRC staff in letters dated September 22, 2004 (ADAMS accession number ML042660426), and November 4, 2004 (ML042990009), and in a document dated February 22, 2005 (ML050530094). Based on this review, the licensee concluded that Oconee is safe, but that the Updated Final Safety Analysis Report (UFSAR) needs to be clarified. The licensee stated that it will submit an LAR that will propose changes to the UFSAR that would clarify the licensing basis for tornado mitigation. The NRC stated that if this LAR assesses the tornado risk of each item individually and screens out this item if the risk is acceptable, then the NRC staff would probably not find the LAR acceptable. The NRC staff suggested that the LAR assess the tornado risk of the entire plant.

The licensee discussed its Design Basis Upgrade Initiative, which entails the evaluation of potential modifications, such as installing natural-phenomena barriers, upgrading the station auxiliary service water system, enhancing the electrical system, and upgrading high-pressure injection. The licensee is currently in Phase I of the Design Basis Upgrade Initiative, which involves investigating design concepts, evaluating the feasibility and constructability, and developing cost estimates. The licensee is expecting to complete Phase I and initiate the final design package early in 2006.

Duke Energy The licensee agreed to do the following in the near term:

1. Provide the results of the safety review discussed above.
2. Provide the screening criteria used in this review.
3. Submit an LAR that will propose a change to the licensing basis for the Unit 3 control room wall based on results of an analysis using the TORMIS code.
4. Evaluate the current 45-day Completion Time Technical Specification for the Standby Shutdown Facility.
5. Provide a schedule for submission of the LAR that would clarify the licensing basis for tornado mitigation.

The licensee and the NRC staff agreed to have periodic meetings to discuss the progress of the resolution of this issue.
