Dear Mr. Sumner:
By letter dated February 23, 2005, we transmitted the synopsis of a Nuclear Regulatory Commission (NRC) Office of Investigations (OI) completed report. It was subsequently brought to our attention by Mr. Ray Baker of your staff that the synopsis referenced an incorrect position title. After reviewing the OI report, we have determined the position title that should have been referenced in the synopsis. Enclosed for your information is the revised synopsis referencing the correct position title. Please replace the synopsis transmitted with our February 23, 2005, letter with the enclosed revised synopsis.

NOT FOR PUBLIC DISCLOSURE WITHOUT APPROVAL OF FIELD OFFICE DIRECTOR, OFFICE OF INVESTIGATIONS, REGION II Case No. 2-2004-038 SYNOPSIS This investigation was initiated by the U.S. Nuclear Regulatory Commission Office of Investigations, Region II, on July 2, 2004, to determine if a reactor operator (RO) at the Georgia Power Companys (GPC) Hatch Nuclear Power Plant (Hatch), deliberately withheld information relating to a 1995 arrest and/or if the licensee had this information and failed to report it to the NRC.
Based on the evidence developed during this investigation, the allegation that a RO deliberately withheld information relating to a 1995 arrest was not substantiated. However, although not initially part of the original allegation, coverage of logical investigative leads substantiated that a currently titled Engineering Support Manager (ESM), during a past assignment as Superintendent of Shift (SS), received the arrest information and willfully failed to make proper notification to licensee management and as a result, to the NRC.
