March 29, 2005 Mr. James A. Spina Vice President Nine Mile Point Nine Mile Point Nuclear Station, LLC P.O. Box 63 Lycoming, NY 13093

SUBJECT:

NINE MILE POINT NUCLEAR STATION, UNIT NO. 1 - INSPECTION OF CORE SHROUD SUPPORT WELD H9 INSPECTION SCOPE (TAC NO. MC5642)

Dear Mr. Spina:

By letter dated January 14, 2005, you requested Nuclear Regulatory Commission (NRC) approval of a proposed change to the H9 weld recirculation N1 nozzle locations to be inspected during Refueling Outage 18. Your letter stated that inspection commitments had been agreed to by the NRC staff in its letter dated December 13, 2002.

On March 10, 2005, you revised your January 14, 2005, letter by stating that the proposed change to the H9 weld inspection scope should have been processed as a commitment change using Nuclear Energy Institute 99-04, Guidelines for Managing NRC Commitment Changes as endorsed by NRC Regulatory Issue Summary 2000-17, Managing Regulatory Commitments Made by Power Reactor Licensees to the NRC Staff.

The NRC staff reviewed your letters and agreed that they address a change of inspection scope that can be effected under the commitment management program you referenced.

Accordingly, there is no need for the NRC staff to issue any revision to its previous evaluation.

This closes all efforts covered by the above TAC number.

Sincerely,

/RA/

Peter S. Tam, Senior Project Manager, Section 1 Project Directorate I Division of Licensing Project Management Office of Nuclear Reactor Regulation Docket No. 50-220 cc: See next page
