TURKEY POINT UNITS 3 AND 4 - RESULTS OF ACCEPTANCE REVIEW REGARDING REQUEST FOR EXEMPTION FROM 10 CFR PART 50 APPENDIX R, SECTION III.G.3 (MC5542 AND MC5543) (L-2004-176)
Dear Mr. Stall:
On December 27, 2004, Florida Power and Light (FPL, the licensee) submitted a request for an exemption in accordance with Title 10 to Code of Federal Regulations Part 50 (10 CFR Part 50) from certain requirements of 10 CFR Part 50, Appendix R, Section III.G.3 (III.G.3). Specifically, FPL requested an exemption from the requirements for automatic suppression in the Mechanical Equipment Room (Fire Zone 097) and the Control Room Roof (Fire Zone 106R).
The purpose of this letter is to provide the results of the U. S. Nuclear Regulatory Commission (NRC) staffs acceptance review of the requested exemption. An acceptance review determines whether or not a submittal (e.g., license amendment request, request for exemption) is sufficiently complete to allow the NRC staff to proceed with a detailed review.
The primary objectives of the NRCs fire protection rules and regulations are to (1) minimize the potential for fires and explosions, (2) rapidly detect, control, and extinguish fires that do occur, and (3) ensure that fire will not prevent the performance of necessary safe shutdown functions or increase the risk of significant radioactive releases to the environment.
The NRC staff reviewed the submittal, the applicable sections of the updated final safety analysis, and docketed referenced correspondence. When considering the consequences of a fire in a given fire area or zone during the evaluation of safe shutdown capabilities of the plant, one success path of equipment that can be used to bring the reactor to hot standby should remain unaffected by the fire. The submittal indicates a change in the method to assure safe shutdown capability from III.G.2 to III.G.3, but does not adequately demonstrate that one success path of equipment needed to bring the reactor to hot standby remains unaffected by a fire in these zones.
In order to make the submittal complete, and, therefore, acceptable for detailed review, the following information needs to be provided:
A description and drawings of the fire zones for which the exemption is requested, specifically identifying the location, type, and quantity of combustibles, credible ignition sources, fire protection features, and safe shutdown equipment located in each fire zone;

A description of the fire effects, if any, on all equipment needed to safely shutdown the plant located in the fire zones; and A description of the changes to fire safe shutdown and response procedures needed to support implementation of these exemption requests.
This request was discussed with Ms. Olga Hanek of your staff on March 14, 2005, and it was agreed that a response would be provided within 45 days of the issuance of this letter. Upon receipt of information that adequately addresses these deficiencies, the NRC staff will consider your application complete, such that the detailed technical review can be initiated and a schedule for completing the review can be established.
