Pursuant to 10 CFR 26.71(d), enclosed is the semiannual Fitness For Duty (FFD) Program performance data for the above listed plants belonging to Carolina Power & Light Company, now doing business as Progress Energy Carolinas, Inc. (PEC), and Florida Power Corporation, now doing business as Progress Energy Florida, Inc. (PEF).

The enclosed report provides FFD Program performance data for personnel subject to the requirements of 10 CFR 26, for the period July 1, 2004 through December 31, 2004.

SUMMARY

OF MANAGEMENT ACTIONS Lessons Learned and Actions Taken

SUBJECT:

Results Not Reported By Lab Within 5 Days Of Specimen Receipt (NCR 144494)

The specimen in question was received at Labcorp on November 16, 2004 for drug testing. It screened positive for Opiates and was scheduled for confirmation testing for Codeine and Morphine, as well as 6-Acetylmorphine. The final result was reported on November 27, 2004.

The above specimen was scheduled in multiple batches for Codeine and Morphine confirmation.

Specimens must be repeated in more than one batch when either the quality control specimens in the batch or the donor specimen itself fail to meet the lab's criteria for acceptability. This specimen was initially in a batch with a quality control sample that failed to meet the acceptance criteria. In its second batch, the specimen itself did not meet criteria for acceptance recovery and had to be repeated. When the batch was repeated, it demonstrated a very high concentration of morphine resulting in further extraction at a dilution to resolve the saturation problem. This final extraction of the diluted urine was performed as a single sample batch. The Codeine, Morphine and 6-Acetylmorphine results were posted on this specimen on November 27, 2004 and the results were released to Progress Energy.

Labcorp performs an audit daily to identify Progress Energy's samples currently being tested at the lab. A list of Progress Energy's samples is distributed to key individuals involved in processing the specimens. Due to this incident, Labcorp's Responsible Person will review the requirements to release results within 5 working days with key individuals involved in the processing of Progress Energy's specimens.

Untimely Entry of Workers Into Random Pool (NCR 138422)

Pre-Access FFD collections were completed for three workers, one each on September 21, 22, and 23, 2004. Security procedures were recently changed to require that workers who are in-processing for unescorted access and have completed their Pre-Access collection be placed in the pool of workers subject to random testing. However, the workers were not entered into the random pool until September 27, 2004 due to a combination of overconfidence based on previous experience, substandard performance of the task, and the consequences of certain actions not being understood.

The lessons-learned from this situation were reviewed with the appropriate staff, and relevant management reports were developed to monitor performance in this area.

Incorrect Coding Results in Worker Not Being In Random Pool (NCR 146941)

Due to a failure to perform a self-check, a Pre-Access FFD collection, which was completed on December 20, 2004, was incorrectly coded such that the worker was not placed in the pool of workers subject to random testing. The error was detected and corrected on December 22, 2004, prior to the worker being granted unescorted access.

The staff has been coached on the use of self-checking and peer-checking techniques to include the use of validation reports during peak processing periods.

PE&RAS-05-007 Page 3 of 12 Enclosure EFFECTIVENESS EVALUATION Fitness For Duty Program Performance Data Random testing is required to be performed at an annual rate of at least 50% of the workforce in accordance with 10 CFR 26.24(a)(2). The current six month reporting period random testing rates were approximately 27.8% for Carolina Power and Light Company, now doing business as Progress Energy Carolinas, Inc., (PEC) and 26.1% for Florida Power Corporation, now doing business as Progress Energy Florida, Inc., (PEF). For PEC (i.e., the Brunswick, Harris, and Robinson plants), there were 844 random tests conducted with an average of 3040 workers eligible for testing. For PEF (i.e., the Crystal River 3 plant), there were 199 random tests conducted with an average of 763 workers eligible for testing. The annual testing rate for PEC was approximately 55.5% with 1713 random tests conducted with an average of 3089 workers eligible for testing. The annual testing rate for PEF was approximately 54.8% with 413 random test conducted with an average of 753 workers eligible for testing.

For this reporting period, the total rate of positive test results for PEC was approximately 0.75%. Of 1731 tests, there were 13 positive results, comprising 9 pre-access, 1 random, 3 for-cause, and 0 other. For this reporting period, the total rate of positive test results for PEF was approximately 0.62%. Of 323 tests, there were 2 positive results comprising 1 pre-access, 0 random, 1 for-cause, and 0 other. Unescorted access for the individuals with confirmed positive tests was denied or revoked, as applicable.

For this reporting period, the positive test rate for PEC employees was approximately 0.32%, with 2 positive results out of 631 tests. For this reporting period, the positive test rate for PEF employees was approximately 0.48% with 1 positive result out of 208 tests.

For this reporting period, the positive test rate for PEC contractors was approximately 1.00% with 11 positive results out of 1100 tests. For PEF, the positive test rate was approximately 0.8 7% with 1 positive result out of 115 tests.
