NINE MILE POINT NUCLEAR STATION, UNIT NO. 1 (NMP1) - EVALUATION OF UPPER SHELF FRACTURE TOUGHNESS PER 10 CFR PART 50, APPENDIX G (TAC NO. MC2487)

Dear Mr. Spina:

By letter dated March 22, 2004, Mr. W. C. Holston of your staff submitted report CNS-04-01-01, Revision 1, Evaluation of Upper Shelf Fracture Toughness of the Nine Mile Point Unit 1 Reactor Vessel to the End of the Period of Extended Operation, to the Nuclear Regulatory Commission (NRC) for review and approval in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Part 50, Appendix G,Section IV.A.1.c. According to Section IV.A.1.c, the licensee shall submit an analysis at least 3 years prior to the date when the predicted upper-shelf energy (USE) values do not meet the 50 ft-lb criterion as required by Section IV.A.1 of Appendix G.

In its safety evaluation dated April 20, 1994, the NRC staff approved NMP1's analysis of USE values of the limiting beltline materials of the NMP1 reactor vessel through 25 effective full-power years (EFPY) of operation. At this time, NMP1 will reach 25 EFPY in approximately March 2007. However, since the current license for the NMP1 is valid until August 22, 2009, your staff recognized a need to provide a reassessment of the USE values for the NMP1 reactor vessel. By this letter, the NRC staff acknowledges that the licensee provided its reanalysis in accordance with the timeliness requirements of 10 CFR Part 50, Appendix G, Section IV.A.1.c.

However, the reanalysis also extended the USE evaluation through a proposed period of renewed license operation. Consistent with its practice, the NRC staff will not make a determination regarding an evaluation which should be addressed within the scope of a licensees license renewal application (the NMP1 application is currently under review). The NRC staff will review the topic of the licensees USE evaluation as a time-limited aging analysis within the scope of the license renewal review for NMP1. Based on the current schedule, the NRC staff expects to complete its review of the NMP1 license renewal application and associated USE evaluation prior to expiration of the existing NMP1 USE analysis in March 2007. Consequently, the NRC staff is terminating its review efforts (i.e., TAC No.

MC2847) under the current operating license; the review is continuing under the NMP1 license renewal activities.
