DRAFT SAFETY EVALUATION REPORT FOR THE EXELON EARLY SITE PERMIT APPLICATION

Dear Sir or Madam:

On February 10, 2005, the U.S. Nuclear Regulatory Commission (NRC) staff issued its draft safety evaluation report (DSER) for the application by Exelon Generation Company, LLC (Exelon) for an early site permit (ESP) for the Exelon Generation Company (EGC) ESP site.

We are enclosing a CD-ROM copy of this document for your information.

The DSER provides information to stakeholders regarding the status of completion of the staffs review of safety aspects of Exelons ESP application and the remaining information needed for issuance of the final SER (FSER). Because the DSER contains open items (subjects for which Exelon has been requested to provide additional information), the NRC staff has not made a decision regarding whether to recommend to the Commission that an ESP be issued for the EGC ESP site.

In addition, the staff has not, at this time, completed its review of the information in Section 2.5, Geology, Seismology, and Geotechnical Engineering, and Section 3.4.2, 10 CFR 100.23Geologic and Seismic Siting Criteria, of Exelon's site safety analysis report (SSAR).

Therefore, the staff plans to issue a supplemental DSER that will summarize the results of its technical evaluation of the suitability of the proposed EGC ESP site in terms of the sites seismology and geology. The staff expects to issue the supplemental DSER no later than May 31, 2005. In the letter dated November 15, 2004, the staff indicated that the supplemental DSER will likely result in a delay in the issuance of the FSER. The staff plans to provide a revised schedule in the letter transmitting the supplemental DSER.

At the time the DSER was issued, the NRC informed Exelon that it would withhold the DSER from public disclosure for 14 calendar days to allow Exelon the opportunity to verify, in consultation with the State of Illinois and the Illinois Emergency Management Agency, the NRC staffs conclusion that the DSER does not contain proprietary or sensitive information that should be withheld from public release in accordance with NRC regulations. By letter dated February 23, 2005, Exelon requested an additional 7 calendar days for Exelon and the State of Illinois to complete their review. Therefore, the staff extended the proprietary review period.

Upon completion of the proprietary review period, the State of Illinois identified a few sentences in Chapter 13, Conduct of Operations, which contained information from the State and local emergency plans that the State of Illinois requested to be withheld from public disclosure. In accordance with SECY-04-0191, Withholding Sensitive Unclassified Information Concerning Nuclear Power Reactors From Public Disclosure, and the accompanying staff requirements memorandum dated November 9, 2004, the staff agrees that this information should be withheld from public disclosure. On the basis of this determination, the staff redacted Chapter 13 to remove the sensitive information. In some cases the text was rewritten to remove the sensitive information and in other cases the text was removed in its entirety.

Accordingly, the staff has made the DSER available for public inspection on the NRCs public web site at http://www.nrc.gov/reactors/new-licensing/esp/clinton.html. In addition, the document is available through the NRCs Public Document Room and the Publicly Available Records (PARS) component of ADAMS, the NRCs document management system. ADAMS is accessible from the NRC web site at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room). The ADAMS accession number for the DSER is ML050630183.
