SUBJECT:
USE OF UNDOCKETED INFORMATION BY THE NUCLEAR REGULATORY COMMISSION (NRC) STAFF IN NINE MILE POINT NUCLEAR STATION AMENDMENT NO. 161 (INSPECTOR GENERAL CASE NO.04-811; YELLOW TICKET NO. 020050009; TAC MC5556)
By a memorandum (G. A. Mulley to J. E. Dyer) dated December 16, 2004, the Office of the Inspector General stated that undocketed information (mostly calculations) was used in the safety evaluation of the above referenced amendment. It also stated that to date these calculations have not been docketed. As a part of actions required to resolve this matter, the NRC staff has docketed this information, in the public domain. These calculations were used by the reviewers in the decision-making on the compensatory action required to approve the emergency amendment.
I consulted with A. Mohseni, P. Tam, R. Weisman, and J. Hayes, and adopted this solution.
The previously undocketed information is hereby docketed in the public domain.
