SUBJECT:

CLOSURE OF TAC NOS. MC5222 AND MC5223 - SEQUOYAH NUCLEAR PLANT, UNITS 1 AND 2 The purpose of this memorandum is to document closure of TAC Nos. MC5222 and MC5223 for the Sequoyah Nuclear Plant, Units 1 and 2.

U.S. Nuclear Regulatory Commission (NRC) Regulatory Issue Summary (RIS) 2003-18, Supplement 1, Use of Nuclear Energy Institute (NEI) 99-01, Methodology for Development of Emergency Action Levels, Revision 4, dated January 2003, was issued on July 13, 2004. The RIS cited inconsistent implementation of Emergency Action Levels (EALs) to the endorsed NEI 99-01, Revision 4 scheme and recommended that licensees schedule pre-submittal conferences with the NRC staff in order to clarify NRCs expectations for documentation and to provide an understanding of the process by which the change will be evaluated.

By letter dated December 1, 2004 (ADAMS accession number ML043420145), the Tennessee Valley Authority (TVA) provided information regarding proposed EAL changes involving the Sequoyah Steam Generator Tube Rupture, Containment By-pass, and removal of area radiation monitors from waste packaging and decontamination rooms in order to facilitate a joint TVA/NRC EAL safety evaluation preconference. TAC Nos. MC5222 and MC5223 were taken out to support this request.

In response to the licensees request, on January 19, 2005, a conference call was conducted between representatives of TVA, Nuclear Reactor Regulation staff, and Nuclear Security and Incident Response staff. The conference call satisfied the objectives of both the licensees request and TAC Nos. MC5222 and MC5223. Therefore, TAC Nos. MC5222 and MC5223 are closed.
