PURPOSE: This meeting is a Predecisional Enforcement and Regulatory Conference,

the purpose of which is to provide the licensee an opportunity to present to

the NRC their perspectives on the facts and the process used by the NRC to

arrive at the potential Greater than Green finding and an apparent violation of

10 CFR 50.59 described in NRC Inspection Report 05000528/2004014,

05000529/2004014, and 05000530/2004014 (ML050050287). The potential

Greater than Green finding involved the failure to maintain design control of

the containment sump safety injection suction piping at all three PVNGS

units. Specifically, a significant portion of this piping was not consistently

maintained full of water since initial operation of all three units. The apparent

violation involved the failure to perform a written safety evaluation and

receive NRC approval prior to implementing changes to procedures in 1992

which involved draining, and maintaining drained, a significant segment of

containment sump safety injection suction piping. As part of our disposition

of this apparent violation, the NRC will determine whether enforcement action

is warranted.
