Davis (NEI), dated November 19, 2004, NEI Use of Encryption Software for Secure Transmission of Safeguards Information On June 16, 2004, the Nuclear Regulatory Commission (NRC) authorized Constellation Generation Group, LLC to use Pretty Good Privacy (PGP) software Corporate Software Desktop Version 8.0 for encryption and electronic transmission of Safeguards Information (SGI) for Calvert Cliffs Nuclear Power Plant, Units I and 2, Independent Spent Fuel Storage Installation Facility, and Nine Mile Point Nuclear Station, Units I and 2 (Reference a).

The NRC also authorized Rochester Gas and Electric Corporation to use PGP softvare Desktop Version 8.0 for encryption and electronic transmission of SGI for R. E. Ginna Nuclear Power Plant on July 6, 2004 (Reference b).

Document Control Desk December 17, 2004 Page 2 In an October 4, 2004 letter to the NRC (Reference c), the Nuclear Energy Institute (NEI) provided notification of the industry's intent to use PGP Version 8.0.3.

In their response to the NEI letter, Reference (d), the NRC authorized the use of PGP Version 8.0.3 for processing SGI electronically.

Based on discussions with members of your staff, it was confirmed that the October 4, 2004 letter (Reference c) meets the requirement that the NRC be notified 30 days before "first use" of new software, as stated in References (a), (b), and (d). Therefore, it is not necessary for us to wait 30 days from the date of this letter before we begin using PGP Version 8.0.3.

This letter provides notification that Constellation Generation Group, LLC may begin using PGP Software Corporate Desktop Version 8.0.3, which was developed with PGP Software Development Kit (SDK) 3.0.3, immediately. National Institute of Standards and Testing Certificate Number 394 validates compliance of this software development tool with the Federal Information Processing Standard 140-2 requirements.
