Please confirm that this notice from the Division of Facilities and Security is sufficient to assure you that Edward Johns has the requisite safeguards clearance to transcribe the deposition of Howard B. Williams on December 7. If I do not hear from you by close of business today, I will assume that it is acceptable.

Dear Ms. Smith,

I am an attorney for the Blue Ridge Environmental Defense League, which has intervened in a license amendment case involving the Catawba nuclear power plant. On Tuesday, December 7, I am scheduled to take a

deposition of a Duke Energy Corporation employee at the Catawba plant.

I have arranged with Neal Gross and Co. to have court reporter Edward Johns make a transcript of the deposition. I believe Mr. Johns has recorded a number of closed sessions involving safeguards information, in the same proceeding.

Duke has asked for written confirmation that Mr. Johns has the appropriate clearance to record a safeguards deposition. Please provide that confirmation, and copy it to the other parties that are copied on this message.
