ST. LUCIE, UNITS 1 AND 2 - WITHDRAWAL OF REQUEST FOR RELAXATION AND ENFORCEMENT DISCRETION FROM ORDER EA-03-038 (TAC NOS. MC3408 AND MC3409)

Dear Mr. Stall:

By letter dated June 4, 2004, Florida Power and Light Company (FLP) submitted a request for relaxation and enforcement discretion from the Nuclear Regulatory Commission (NRC) Order EA-03-038. Specifically, FPL requested that the NRC grant a temporary relaxation and enforcement discretion of the compensatory measures regarding the average work hour limits specified in Attachment 2, paragraph C.2.(a) of the NRC Order EA-03-038. Subsequently, by letter dated October 7, 2004, FPL withdrew the requested relaxation and enforcement discretion, and stated that corrective measures implemented by FPL had removed the need for the requested relaxation and enforcement discretion.

The purpose of this letter is to advise you that the above application for relaxation and enforcement discretion is being treated as withdrawn. No further actions will be taken under TAC Nos. MC3408 and MC3409.
