ST. LUCIE UNITS 1 AND 2 - REQUEST FOR ADDITIONAL INFORMATION REGARDING REQUEST FOR RELAXATION AND ENFORCEMENT DISCRETION FROM THE FITNESS-FOR-DUTY ORDER FOR NUCLEAR FORCE PERSONNEL (TAC NOS. MC3408 AND MC3409)

Dear Mr. Stall:

By letter dated June 4, 2004, Florida Power and Light Company (FPL) submitted request for temporary relaxation and enforcement discretion from U.S. Nuclear Regulatory Commission (NRC) Order for Compensatory Measures Related to Fitness-For-Duty Enhancements Applicable to Nuclear Security Force Personnel (Order, EA-03-038), dated April 29, 2003, for St. Lucie Units 1 and 2. Specifically, FPL requested a temporary relaxation and enforcement discretion of the compensatory measures of the Order regarding the average work hour limits specified in Attachment 2, paragraph C.2(a) of the Order.

The NRC staff has reviewed your submittal and finds that a response to the enclosed request for additional information is needed before we can complete the review. This was discussed with members of your staff, and Mr. George Madden indicated that a response would be provided by August 30,2004.

1. With regard to the abrupt departure of eight security officers, the request does not provide sufficient information to establish good cause for relaxation. Please provide the following additional information:
a. What was the reason for the abrupt departure of the eight security officers?
b. When did the departure occur and when did FPL know that the eight officers were leaving?
c. The submittal states that this is believed to be an isolated case requiring no actions to prevent recurrence. Please provide justification for this assumption.
2. Please provide the work-hour averages for the 6-week averaging periods ending June 6, 2004, July 18, 2004, and August 29, 2004.
