Settlement of Contention 6

Dear Mark and Anne,

I am writing to follow up on the discussions we have had regarding possible settlement of Blue Ridge Environmental Defense League's Contention 6. We are prepared to drop the contention if Duke will commit to a definition of radiological sabotage against MOX fuel assemblies that is based on "significant damage" to the assemblies. We are not prepared to drop the contention if Duke defines radiological sabotage of MOX fuel assemblies as damage that would be sufficient to cause a Part 100 release.

Please let me know as soon as possible whether the definition of sabotage that is proposed by BREDL is acceptable to Duke.
