Dear Administrative Judges:

In its October 1, 2004 Order (Confirming Scheduling and Other Matters Addressed at September 28, 2004, Closed Session), the Licensing Board allowed Duke and BREDL to file responses to information provided by the Staff relating to three questions discussed in the September 28 closed session at Tr. 3543-45. The NRC Staff has addressed these three questions in its response to Specific Interrogatory No. 3 contained in NRC Staff's

-Response to the Blue-Ridge Environmental-Defense League's Second Set of Discovery-Requests- -

to NRC Staff Regarding the Security Plan Submittal dated October 5, 2004.

Duke's understanding as to the type of information assumed to be available to the insider and the mock adversary team is similar to that of the Staff's as set forth in the interrogatory response. Duke submits that such information constraints should be used in evaluating any theft or diversion scenario in this proceeding.
