Dear Mr. Fernandez:

On September 3, 2004, Ms. Diane Curran, counsel for Intervenor Blue Ridge Environmental Defense League ("BREDL") in the Duke Energy Corporation ("Duke") MOX fuel lead assembly license amendment proceeding, asked for copies of certain Catawba Nuclear Station security procedures. Ms. Curran made this request based upon her review of a listing of such security procedures (indicating the number, title, and current revision number) that Winston

& Strawn had provided to Ms. Curran earlier that day.

By this letter, I am forwarding to you copies of the ten (10) Catawba security procedures that Ms. Curran has requested. Duke requests that the NRC Staff make a "need to know" determination regarding each of these procedures. Should the Staff decide that BREDL has a need to know, Duke further requests that the Staff determine whether each procedure should be redacted. Finally, I would appreciate your prompt attention to this matter, to minimize any potential effect upon the schedule in this proceeding.
