MID-CYCLE PERFORMANCE REVIEW AND INSPECTION PLAN -

SEABROOK STATION

Dear Mr. Warner:

On August 4, 2004, the NRC staff completed its mid-cycle plant performance assessment of Seabrook Station. The mid-cycle review for Seabrook involved the participation of all technical divisions in evaluating performance for the first half of the calendar year 2004 assessment cycle.

The process included a review of performance indicators (PIs) for the most recent quarter and inspection results over the previous twelve months. The purpose of this letter is to inform you of our assessment of your safety performance during this period and our plans for future inspections at your facility so that you will have an opportunity to prepare for these inspections and to inform us of any planned inspections that may conflict with your plant activities. This performance review and enclosed inspection plan do not include physical protection information. A separate letter designated and marked as "Proprietary Information in accordance with 10 CFR 2.390(d)(1)" will include the physical protection review and resultant inspection plan.

Plant performance for the most recent quarter was within the Licensee Response Column of the NRCs Action Matrix, based on all inspection findings being classified as having very low safety significance (Green) and all PIs indicating performance at a level requiring no additional NRC oversight (Green). While plant performance for the most recent quarter was within the Licensee Response Column of the Action Matrix, there was one White PI during the fourth quarter of 2003 in the Barrier Integrity cornerstone. The PI for Reactor Coolant System (RCS) Leakage exceeded the Green/White threshold due to a reactor coolant system flow instrument leak that occurred on November 11, 2003. The PI returned to the Green band of the NRCs Action Matrix in the first quarter of 2004. In response to the White PI, the NRC staff conducted a Supplemental Inspection during the second quarter of 2004 and concluded that you properly assessed the extent of condition, determined the primary and contributing causes of the failure, and identified corrective actions to address the root and contributing causes. However, the staff identified one aspect of the corrective actions that was not timely implemented and issued a very low safety significance (Green) finding. We plan to conduct only reactor oversight process (ROP) baseline inspections at your facility through March 31, 2006.

Mr. Mark E. Warner 2 The significance of an apparent violation involving the failure to properly implement 10 CFR 50.59 for a change to the Seabrook Updated Final Safety Analysis Report (FSAR) is still under review.

Since the change involved more than a minimal increase in the frequency of occurrence and the consequences of an accident previously evaluated in the Seabrook FSAR, the change required prior NRC approval, but approval was not requested. The NRC has not made a final determination in this matter, therefore, no Notice of Violation has been issued at this time.

The enclosed inspection plan details the inspections scheduled through March 31, 2006. The inspection plan is provided to minimize the resource impact on your staff and to allow for scheduling conflicts and personnel availability to be resolved in advance of inspector arrival onsite. Routine resident inspections are not listed due to their ongoing and continuous nature.

The inspections in the last twelve months of the inspection plan are tentative and may be revised at the end-of-cycle review meeting.

In accordance with 10 CFR 2.390 of the NRCs Rules of Practice, a copy of this letter and its enclosure will be made available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records (PARS) component of NRC's document system (ADAMS).
