OF MAY 19, 2004, MEETING WITH NUCLEAR ENERGY INSTITUTE REGARDING INTERIM SAFETY ASSESSMENTS CONCERNING LICENSEES PLANT-SPECIFIC SUMP EVALUATIONS (TAC NO. MA6454)

On May 19, 2004, a Category 2 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Nuclear Energy Institute (NEI) at NRC Headquarters, Two White Flint North, 11545 Rockville Pike, Rockville, Maryland. The purpose of the meeting was for NEI to inform the NRC staff of its proposal for interim safety assessments for licensees that complete a plant-specific evaluation of sump performance. A list of attendees is provided as an Attachment. Neither NEI representatives nor the NRC staff used handouts or other presentation aids during the meeting.

The original purpose of the meeting was for NEI to inform the NRC staff of its planned development of a proposal for interim safety assessments for licensees that complete a plant-specific evaluation of sump performance and discover a nonconformance. However, NEI did not present any such proposal. Instead, NEI asked the NRC staff several questions about the implementation of the proposed Generic Letter (GL) 2004-xx, "Potential Impact of Debris Blockage on Emergency Recirculation During Design-Basis Accidents at Pressurized Water Reactors," which was issued for public comment. Many of the questions concerned: (1) time needed to implement the actions necessary to respond to the GL, (2) NRC review and inspection of boiling-water reactors resolution of strainer blockage issue, (3) regulatory basis for the GL, (4) whether the GL constituted a backfit, and (5) applicability of PWRs licensing bases. Since the meeting, many of the questions raised by the NEI representatives have been submitted to the NRC by industry representatives as comments on the proposed GL, prior to the end of the public comment period of June 1, 2004, for the GL.

Members of the public were in attendance. Three Public Meeting Feedback forms were received. Comments received included the following: (1) the noticed meeting purpose was not addressed, (2) meeting was similar to a meeting held earlier in the day on the proposed GL, and (3) the availability of a telephone conference line was not publicized. These have been forwarded to the NRR Senior Communications Analyst who will forward them to the Office of the Executive Director for Operations.
