Dear Mr. Wetterhahn:
I am responding to your request for need-to-know determinations regarding documents responsive to document requests made by the Blue Ridge Environmental Defense League (BREDL) addressed to Duke Energy Corporation (Duke) in the course of the instant proceeding. In a letter dated August 3, 2004, the Staff rendered need-to-know determinations on five documents. In this letter, the Staff makes additional need-to-know determinations with regard to three documents identified by Duke in its letter to Ms. Uttal and myself, dated July 6, 2004. Further, the Staff has concluded that no other documents identified by Duke as responsive to BREDLs first round of discovery requests necessitate a need-to-know determination by the NRC Staff.
For the reasons that the Staff articulated in its letter to Ms. Diane Curran on August 3, 2004, the Staff has determined that BREDL does not have the requisite need-to-know to grant them access to: (1) Supplemental Response to April 29, 2003 Order (Apr. 27, 2004); (2) Request of Additional Information (June 8, 2004); (3) Request for Additional Information (June 14,2004).
