Dear Sir or Madam:

By letter dated October 31, 2003, Indiana Michigan Power Company (I&M) submitted an application to renew the operating licenses for Donald C. Cook Nuclear Plant (CNP), Units I and 2 (Reference 1). Appendix E to the license renewal application contained the Applicant's Environmental Report -

Operating License Renewal Stage. I&M submitted information to supplement the Environmental Report in a June 4, 2004, letter (Reference 2), which included a commitment to submit additional information pertaining to the -Company's practices for notification of Federal and/or State agencies upon identification of threatened or endangered species bird mortalities or problem nests along the transmission corridors.

This submittal provides the additional information required to satisfy the commitment made in Reference 2:

I&M's avian management and conservation awareness activities provide the appropriate elements to ensure the protection of all native bird species listed in the Migratory Bird Treaty Act, the Bald and Golden Eagle Protection Act, and the Endangered Species Act. The avian management and conservation activities apply to l&M employees and contractors who perform work at the CNP site and along the corridors for the I&M transmission lines that support CNP operation.

The key elements pertaining to notification of the proper authorities when workers encounter mortalities, injuries, or problem nests of protected species are:

Informing workers of nesting and roosting behaviors for protected birds and mammals, with particular emphasis on large avian species (i.e.,

eagles, hawks, and other birds of prey);

U. S. Nuclear Regulatory Commission AEP:NRC:4034-14 Page 2 Establishing points-of-contact for all issues pertaining to large avian mortalities, injuries, and problem nests;

  • Identifying and documenting problem nests and obtaining the necessary U. S. Fish and Wildlife Service (USFWS) permits prior to disturbing or relocating problem nests for eagles and other federally-protected species; Documenting bird mortalities, and providing notification to the appropriate USFWS regional or field office; and
  • Providing resources and training (currently in progress) to improve transmission line workers' knowledge and awareness of regulatory requirements pertaining to the protection of all bird species, with particular emphasis on bald eagles, other raptors, and large wading birds.

There are no new commitments made in this submittal.
