Dear Ms. Sansone:
I am responding to a concern you raised at the April 15, 2004, public meeting in Lacey Township following our Annual Assessment meeting with the management of the Oyster Creek facility. Specifically, you were concerned that the planned construction of a shopping mall and a new marina along the intake canal for the Oyster Creek Nuclear Generating Station poses a security risk to the facility. You requested that the NRC forward this concern to the Department of Homeland Security.
The Senior Project Engineer in my branch, Mr. Richard S. Barkley, P.E., contacted you on June 3 and informed you of our actions in this matter. Specifically, we discussed this matter with our Office of Nuclear Security and Incident Response (NSIR) in Washington who indicated that such offsite security risk evaluations are conducted in New Jersey by the State Office of Counter Terrorism under a Department of Homeland Security (DHS) sponsored program called the Buffer Zone Protection Program. This program is focused on nearby offsite risks posed to large industrial facilities, such as refineries and chemical processing plants, as well as large power plants. Mr. Barkleys discussions with the NJ State Office of Counter Terrorism (609 /
462-3434) indicated that they would discuss this concern with DHS, but have not yet reviewed the areas surrounding the two nuclear sites in New Jersey due to substantial ongoing security upgrades onsite at these facilities in order to meet enhanced NRC security requirements.
Based on the information you provided, the nature of the land development planned and the location of the facility (i.e., on private land well beyond the owner controlled area of Oyster Creek), the NRC does not have a concern with this proposed development at this time. We note that navigation on the canal is not limited east of the Route 9 bridge; moreover, the facility can be safely shutdown in the event that the intake canal is obstructed. If you have continued concerns in this matter or can provide additional information to support your concern, we urge you to contact the New Jersey State Office of Counter Terrorism at the number provided above.
We feel that we have been responsive in this matter and appreciate your effort to bring this concern to our attention.
