FPL ENERGY SEABROOK, LLC - STRETCH POWER UPRATE ACCEPTANCE REVIEW FOR SEABROOK STATION, UNIT NO. 1 (TAC NO. MC2364)

Dear Mr. Warner:

By letter dated March 17, 2004, as supplemented by a second letter dated March 17, 2004, and letters dated April 1, and May 26, 2004, FPL Energy Seabrook, LLC (FPLE), submitted its application to increase the licensed thermal power level at Seabrook Station, Unit No. 1. The proposed amendment would allow the maximum authorized power level to increase by approximately 5.2 percent, from 3411 megawatts thermal (MWt) to 3587 MWt.

On April 27, 2004, the Nuclear regulatory Commission (NRC) staff conducted a conference call with representatives from FPLE to discuss the basic content and supporting information contained in the March 17, 2004, application. Additionally, on May 20, 2004, we conducted a public meeting on the issues discussed in the conference call. In response to the discussions, FPLE supplemented its application by letter dated May 26, 2004.

The purpose of this letter is to provide the results of the NRC staffs acceptance review of your stretch power uprate application. The acceptance review determines whether or not there is sufficient detail to allow the staff to proceed with its detailed technical review. The review also ensures that the application adequately characterizes the regulatory requirements and licensing basis of the plant.

Based on the review of the information provided in the submittals mentioned above, the NRC staff has determined that FPLE has provided the necessary information for the staff to begin a detailed technical review. Additionally, the staff has determined that your application meets the criteria for a stretch power uprate as the requested power increase is less than 7 percent, and there are no major modifications required to support the uprate. In the May 26, 2004, submittal, FPLE provided additional clarifying and supporting information for balance-of-plant and reactor systems impacted by the power uprate to assist the staff with its detailed review. The NRC staff expects to complete its detailed review by your requested date of February 28, 2005.
