Dear Mr. Fernandez:
On March 9, 2004, Duke Energy Corporation (Duke Energy), licensee in the captioned matter, submitted a Revised Attachment 1 to its September 15, 2003 Security Submittal in support of its application for the use of four lead assemblies of mixed oxide fuel at its Catawba Nuclear Station. The Security Submittal was identified as Safeguards Information.
By this letter, in accordance with the process utilized in this proceeding, Duke Energy requests that the NRC Staff determine whether counsel for BREDL and BREDL's designated expert have a "need to know" justifying access to this Safeguards Information in Revised Attachment 1.
Inasmuch as counsel for BREDL has already been granted access to both the base document and the responses to the RAIs which required the changes to the base document, we would hope that access could be granted quickly.
