MILLSTONE POWER STATION, UNIT NO. 3 - REVIEW OF PROPOSED REVISION TO THE PREVIOUSLY-APPROVED DEVIATION FROM BRANCH TECHNICAL POSITION CMEB 9.5-1 (TAC NO. MB8731)
Dear Mr. Christian:
By letter dated April 17, 2003, Dominion Nuclear Connecticut, Inc. (DNC) submitted for approval a deviation request to the previously-approved deviation from Branch Technical Position CMEB 9.5-1, Guidelines for Fire Protection for Nuclear Power Plants, Section C.7.c.
In discussions with your staff, DNC was told that a deviation was no longer the process for the Nuclear Regulatory Commission (NRC) staff review and approval of this change. Instead, it was necessary for DNC to submit a proposed license amendment for approval since this change would entail a change in your license condition. As a result of those discussions, DNC formally submitted a proposed amendment for approval by letter dated April 15, 2004. As such, the NRC staffs review of the April 17, 2003 submittal will be discontinued. TAC MB8731 for the review of the April 17, 2003 submittal will be closed, and a new TAC number to cover the review of the April 15, 2004 submittal will be opened.
