1. Event Description Bascd upon new information received duringa telephone call on Aug. 23, the REt r-NGGC-0010 review for J:C ippears to be Inadequate. Licensecs routinely credit m inual 4 actions in safe shutdown stratcgies ror fire. In late 2001, NRC inspectors began cl allenging that practice. Thc industry challenged what appearml to be changing policy witho;it rule making. 'ihe new information rcvealedL that credit for any manual action requires Prior NRC approval. HNP planned to submit the deviation request for manual actions and th; .taction rcnmlns appropriate. In addition, other manual actions may need to be evaluated I ending the NRC resolution of the manual action issue.
2. InvesligatIon Results An internal NRC safe shutdown J fire protection program manual actions guidanc( document issued on 11/14/01 Indican that the use of manual actions In lieu of separation oi protection of equipment required for safe shutdown in casc of lire requires prior NRC appro%at.

Tricnnial NRC fire protection inspection leamns began issuing violations to utilities over this issue in late 2001 and early 2002. More recpnt Instecions have generated unrcsolved Items (UR1s) pending further NRR guidance. EC as prepared and implemcnted Io resolvce a degraded fire barrier NRC violation (white finding). The violation regards the tf crmo-lag

-> fire barrier in th icorn which was determined to be of an indeterminate fire iating. The modification inatiled a qualified 3-houjrfier barer to protec safe shutd twn Division I om fire. There Is no dispute concernin;: the eflecivencss of this modification. iiowvcer, the installation of the new firo barrie created a now firi area that consists of the Om which is now separated from th room. A new safe shutdown.annalyfls was prepared for this new fire area. and, sinc. the

orm interfcring with safe shutdown operations as describec in GL 81-12 clarifications. The 50.59 prepard for the EC screened the change out from 50. i9 review because the full scope of the modification is evaluated under the fire protcction pr gram change attachmnanm. 8This was appropriate and meets the current procedure requirer ients of REG-NGGC-00 10. The rime protection program change evaluation concluded that the modification did not adversely affect the ability to achieve and maintain safe shutd )wn in the event of a fire as described under license condition 2F, and therefore prior NRC re'iew and approval was not required. The concern now is that: Since the EC includes manua actions, nnd the current NRC position is that manual actions require prior review and apprc val, then the fite protLection program change evaluation may need to be revised to indicate tl, at prior NRC ryiew and approval is requircd and the EC must then be submitted to the Ni .C.

However, It is still unclear in recent discussions with the NRC if the manual action; can be uccepted byHNP under license condition 2F or if a deviation request needs to be 6 tbmitted.

In addition, tho NRC will not close the associated lire barrier violation until the mt nuni actions air either reviewed and approved by the NRC or new guidance concerning -he

acceptability of manual actions is distributed by NRR ullowing I1NP to accept the manual actions under license condition 2F.

As a result of the above regulatory activity, an industry Issue has also been raised egarding plant safe shutdown in case of fire analyses that credit operator actions outside of he main control room (manual pctions) In lieu of separation or protectlion or redundant saf: shutdown equipment (includingJ The industry, through NEf, has presented a posiliol to the NRC that manual actions are acceptable, as used throughout the industry and as d(scribed in Generic Letter 81-12 clarifications, as long as Lhese actions ae shown to be feasible. The NRC has agreed to change the fire protection rule and is preparing further guildanc 3 on the issue for usc by the Inspection tcams, The rule change and further guidance is exr ected to include requirements concerning how to show that manual actions are feasible, N IC and NEI information concerning feasibility evaluation methods is available. Depending on the results of Industry and NRC activity surrounding this issue, feas ibility cvaluations may also be needed for manual actions currently specified for other H 4P firc areas ora bounding feasibility evaluation for the most limiting fire area that credit imanual actions.

3. Apparent Cause(s) (Number each cause and refercnco the number in section 6 bc ow) 3.1 The apparent cause of the manual actions issue and the conclusions renchcd Ir the EC 48802 REG-NGGC-0010 evaluation is a change In interpretation of the fire protec tion regulations by the NRC concerning the use of manual actions for safe shutdown, ;nd unccrtainty at HNP concerning how the use of manual actions should be evaluated against license condition 21 when making changes to the plant fire protection program. It is still uncertain If prior approval of manual actions by the NRC is required in order to co mply with license condition 2F.

RESPONSE

A manual action feasibility study was completed for the manual actior s rcquired as a result of a fire in the [CP7Room. The results of the feas. bility study and a summnary of the manual actions are contained in E C AttachmentindIlespectively.

A rcview of the REG-NGGC-OOl( evaluation for E was conducted and no changes to the evaluation was required as a result of tie manual action feasibility study.

RESPONSE

Based on results of NRC Trienniel Fire Protection Inspection, feasibility evaluations for required SSD manual actions are prudent and will be pciformed. A schedule for completion shall be developed for each firn area.
