Subject:

BREDL's Proposed Redactions from ASLB Decision dated April 29, 2004 Duke wishes to inform the Licensing Board that it does not agree with BREDL's suggestion in its April 29, 2004 e-mail to the Staff and Duke that the Licensing Board's proposed redaction on the bottom of page 59 of its April 30, 2004 Memorandum and Order (Ruling on Security-Related Contentions) should not be made.

Given the nature of the redaction issues raised by the parties, Licensee asks that the Board consider a more informal conference-type setting during the closed session scheduled for May 14, 2004, similar to the previous conference related to transcript redactions. This would allow greater participation of the experts in Safeguards Information. Such session could be either on or off the record at the discretion of the Board. Thank you for your consideration of this matter.
