Comments on NRC Staff proposed redactions from ASLB security order
Dear ASLB and parties,
BREDL has questions about the necessity or advisability of several of the NRC Staffs Proposed Redactions to the Boards Order on Admissibility of Security Contentions. They are:
On pages 43, 53, bottom of 58 and 67, the NRC Staff proposes to redact portions of the order that identify the regulations from which Duke is seeking an exemption, or describe the content or purpose of the regulations. For the same reasons stated in our comments on the ASLBs proposed redactions, we think this information should be public.
Regarding the proposed redaction in the middle of page 56, we do not believe that a claim by BREDL that Duke has not satisfied some aspect of an NRC regulation should be protected as safeguards information.
Regarding the second proposed redaction on page 56, BREDL does not believe it is appropriate to redact a statement of BREDLs opinion regarding the general effectiveness of a publicly disclosed security measure used by Duke.
Regarding the two proposed redactions from the text on page 63 (not including the footnote), and the proposed redaction on page 64, the highlighted language refers to scenarios posed by BREDL that are based on NRC security regulations. Thus, they do not appear to constitute safeguards information.

BREDL believes that instead of redacting the language proposed by the Staff on page 64, it would be more appropriate to redact the preceding phrase, following "assertion that... " Similarly, the first six words on the 5th line of page 55 may be appropriate for redaction.
Finally, in reviewing the ASLB and Staff proposed redactions today, counsel for BREDL noticed that the ASLB has proposed to redact information regarding the quantity of plutonium contained in MOX fuel assemblies. See page 55 of the Order. It is BREDLs understanding that this is publicly available information.
