ISSUANCE OF NOTICE OF VIOLATION This is to inform the Commission that a Severity Level III Notice of Violation will be issued on or around May 7, 2004, to FirstEnergy Nuclear Operating Company as a result of inspections at the Davis Besse Plant. This violation involved the submission of inaccurate information to the NRC in the licensees response to NRC Generic Letter 98-04, Potential for Degradation of the Emergency Core Cooling System and the Containment Spray System after a Loss-of-Coolant-Accident Because of Construction and Protective Coating Deficiencies and Foreign Material in Containment. The response, dated November 11, 1998, failed to provide complete and accurate information concerning protective coating deficiencies and foreign material in containment.
Because the time has exceeded the statute of limitations, a civil penalty is not being proposed.
Although the staff does not normally provide notice for violations that do not have a proposed civil penalty, the staff elected to provide notice to the Commission for this violation because of the high public interest in the licensee involved and the previous similar violation associated with a Yellow finding issued for the failure to take corrective actions for the coatings. The licensee has taken effective corrective actions in response to the violation.
It should be noted that the licensee has not been specifically informed of the enforcement action.
