This is in response to your request for the Federal Emergency Management Agency (FEMA) to address a concern received by the Nuclear Regulatory Commission (NRC) regarding the State and local planning and preparedness in support of the VC Summer Nuclear Station located in Jenkinsville, South Carolina.

I tasked FEMA's Region IV Office in Atlanta, Georgia, to process your request for assistance. In an effort to provide you with more detail on how issues raised by the Concerned Individual have been addressed, I am enclosing a copy of our regional office's response.

Based on a thorough review of the documentation compiled by FEMA Headquarters and FEMA Region IV staff, it is my determination that the VC Summer emergency response plans and procedures continue to provide reasonable assurance that the public health and safety can be protected in the event of an incident at the VC Summer Nuclear Station.

C. Summer Nuclear Station This is in response to your request for review and evaluation of the request for assistance from the NRC. We forwarded the request to review the allegation to the State of South Carolina.

The State points out that they do not have jurisdiction over providing fire fighting assistance on-site.

However, they contacted the V. C. Summer Nuclear Station regarding the support they receive, if needed, from off-site volunteer fire departments. The V. C. Summer Nuclear station provided copies of Letters of Agreement from the Jenkinsville, Blair, Greenbrier-Bethel, Feasterville, and Lebanon Volunteer Fire Departments. All the volunteer fire departments have agreed to provide support to the V. C. Summer Nuclear Station in the event of a fire emergency and in accordance with the Fairfield County Emergency Operations Plan. According to the plan these 5 volunteer fire departments have 125 volunteer firefighters.

The Fairfield County Emergency Operations plan is an all hazards plan. The response is not dependent on the initiating event, whether accidental or intentional, but on the conditions. Protective action decisions are made with the State of South Carolina and the other affected counties. The decisions are based on plant conditions and radiological monitoring in the area. The counties also have plans in place to address the special needs population in the Emergency Planning Zone. The State and counties have successfully demonstrated their ability to analyze the situation, make decisions and inform the public of any protective actions required through the biennial exercises evaluated by FEMA. The last FEMA evaluated exercise for the V. C. Summer Nuclear Station was July 23, 2003.

Based on our review of the material provided by the State of South Carolina and a review of the Fairfield County Plan, the Fairfield County's plans and procedures continue to provide a reasonable assurance that the public health and safety can be protected in the event of an incident at the V. C. Summer Nuclear Station.

SUMMER NUCLEAR STATION LICENSE RENEWAL In response to your letter dated January 7, 2004, I have reviewed the concerns expressed by Councilman Marcharia of Jenkinsville, SC related to the public meeting on the Draft Environmental Impact Statement for the V. C. Summer License Renewal.

Councilman Marcharia expressed concern that the Jenkinsvifle Fire Department does not have adequate personnel and equipment to respond to an event at the V. C.

Summer Nuclear Station (VCSNS). On May 10, 2003, the Chief of the Jenkinsville, SC fire department, Leonardo O'Neal, signed an updated letter of agreement with the South Carolina Electric & Gas Company (SCE&G) to support the VCSNS in the event of a fire emergency in accordance with Appendix F of the Fairfield County Emergency Operation Plan. In addition, the Volunteer Fire Departments of Blair, Greenbrier-Bethel, Feasterville and Lebanon have all signed letters of agreement to support the VCSNS in the event of a fire emergency as well. Based on these commitments, I am confident that not only Jenkinsville, but also the four additional volunteer fire departments have adequate personnel and equipment to respond to a fire event at the VCSNS.

VCSNS conducted a training class for the volunteer fire departments on April 12, 2003 with representation from Jenkinsville Volunteer Fire Department, along with members of all other volunteer fire departments (VFDs). On September 13, 2003, a successful on-site fire drill was conducted with members of the Jenkinsville VFD and members of the other VFDs responding to a simulated multiple area fire within the V.C. Summer Protected Area. This drill practiced coordination between the V. C. Summer fire brigade and the five VFDs. This fire drill was observed by a VCSNS NRC Resident Inspector, and was included in the quarterly inspection report for the station (Virgil C.

b. Findings Negative corrective action observations regarding CER O-C-03-2730 are documented in Section 40A2 of this report. No other findings of significance were identified.

.2 Annual Fire Drill Inspection

a. Inspection Scope The inspectors observed performance of the licensee's annual fire drill that used offsite

• assistance on September 13, 2003, to evaluate the coordination efforts between onsite and offsite personnel. The fire drill scenario involved a simulated fire due to small plane crashing into the Auxiliary Transformer and turbine building. This drill met the requirements of Emergency Plan Procedure (EP)-100, "Radiation Emergency Plan,"

Section 8.1.2.b, Fire Emergency Drill.

The inspectors evaluated the readiness of the licensee's personnel to prevent and fight fires including the following aspects:

• Observe whether protective clothing and self-contained breathing apparatus (SCBA) equipment were properly worn;

• Determine whether fire hose lines were properly laid out and nozzle pattern simulated being tested prior to entering the fire area-of concern;

• Verify that the fire area was entered in a controlled manner;

• Review if sufficient firefighting equipment was brought to the scene by the fire brigade to properly perform their firefighting duties;

• Verify that the fire brigade leader's fire fighting directions were thorough, clear and effective, and coordinated with offsite fire team assistance'

• Verify that radio communications with plant operators and between fire brigade members were efficient and effective;

• Confirm that fire brigade members checked for fire victims and fire propagation into other plant areas;

• Observe if effective smoke removal operations were simulated;

• Verify that the fire fighting pre-plans were properly utilized and were effective; Verify that the licensee pre-planned drill scenario was followed and the drill objectives met the acceptance criteria, and deficiencies were captured in post drill critiques.

4 The inspectors attended the drill critique to ensure that the licensee addressed all observed areas for improverment. Items noted following the drill were captured in CER O-C-03-2996 in accordance with Fire Protection Procedure (FPP)-026, 'Fire I Hazmat Response."

Documents used to conduct this inspection included:

• Fire Protection Pre-Plan for Transformer Area (fire zone TA, 436' elevation);

• FPP-026, Fire I Hazmat Response;'

• Virgil C. Summer Nuclear Station Critique for Annual Offsite Drill conducted on September 13, 2003 and CER O-C-03-2996, Recommendations from Annual Fire Drill with Offsite Assistance; v CER O-C-03-2866, two SCE&G fire brigade members exhibited symptoms of heat exhaustion during fire drill conducted 9/13103;

• NRC Inspection Procedure 71111.05, 'Fire Protection."

b. Findincis No findings of sigrificance were identified.

IR06 Flood Protection Measures

a. Inspection Scope The inspectors reviewed and walked down two areas regarding internal flood protection features and equipment to determine consistency with design requirements, FSAR and flood analysis documents. Walkdowns were conducted of residual heat removal (RHR),

reactor building spray rooms, and all three charging pumps (CCP) rooms to evaluate flooding vulnerabilities. The inspectors also reviewed room sump pump calculations, penetrations, internal flooding water barrier requirements and CCP room sump pump capacities to verify compliance with calculated flood platform heights. Specific procedures and documents reviewed are listed in the Attachment to this report.

b. Findinns No findings of significance were identified.
