NORTH ANNA POWER STATION UNITS 1 AND 2 PROPOSED TECHNICAL SPECIFICATIONS CHANGES AND EXEMPTION EFFECTIVE DATE AND IMPLEMENTATION SCHEDULE REQUEST FOR USE OF FRAMATOME ANP ADVANCED MARK-BW FUEL In a March 28, 2002 letter (Serial No.02-167) Dominion requested an amendment to Facility Operating License Numbers NPF-4 and NPF-7 and associated exemptions from 10 CFR50.44 and 10 CFR50.46 for North Anna Power Station Units 1 and 2. The amendments and exemptions will permit North Anna Units 1 and 2 to use Framatome ANP Advanced Mark-BW fuel. Dominion requests that NRC issue the amendments for both North Anna Units (License Numbers NPF-4 and NPF-7), to be effective as of the date of issuance, but with implementation delayed as discussed herein.

As noted in previous correspondence, the schedule for introduction of Framatome ANP Advanced Mark-BW fuel at North Anna Power Station is staggered to coincide with the calendar year 2004 refueling outages. Advanced Mark-BW fuel will be loaded in North Anna Unit 2 during the Spring 2004 outage and in Unit 1 during the Fall 2004 outage.

Dominions implementation plan for the introduction of Advanced Mark-BW fuel involves making certain plant procedure and design documentation changes that cannot be fully implemented until the core actually contains Framatome fuel. To provide flexibility in scheduling these needed support tasks, Dominion requests that the NRC indicate the date for implementation of the subject license amendments as follows:

Unit 1 (Renewed License Number NPF-4): implementation to be complete prior to initiation of core onload during Refueling Outage 17 (Fall 2004).

Unit 2 (Renewed License Number NPF-7): implementation to be complete prior to initiation of core onload during Refueling Outage 16 (Spring 2004).

To support the use of Framatome Advanced Mark-BW fuel in North Anna Unit 2, Cycle 17, we respectfully request the NRC to complete their review and approval of the

license amendment by February 29, 2004. We appreciate your consideration of our technical and schedular requests.
