POINT BEACH NUCLEAR PLANT, UNITS 1 AND 2 - WITHDRAWAL OF PROPOSED EMERGENCY PLAN AND EMERGENCY PLAN IMPLEMENTING PROCEDURE CHANGES (TAC NOS. MB1410 AND MB1411)
Dear Mr. Cayia:
By letter dated November 25, 2003, you submitted proposed changes to the Point Beach Nuclear Plant (PBNP) Emergency Plan and Emergency Plan Implementing Procedure 1.2. You requested Nuclear Regulatory Commission (NRC) staff review and approval of the proposed changes.
We performed an acceptability review of your submittal in accordance with 10 CFR 50.4. On January 7, 2004, we held a telephone conference with your staff to inform you of the results of our acceptance review. We indicated that your submittal was not of sufficient detail to provide a "stand alone" justification to support NRC review based on the following: 1) the submittal was not clear as to whether your 10 CFR 50.54(q) review concluded that any of the proposed changes would result in a decrease in the effectiveness of the emergency plan, and 2) the submittal did not include a detailed description of each proposed change, an evaluation of each proposed change against the prior NRC-approved emergency plan section to which the change was being made, and a statement of whether each proposed change would or would not decrease the effectiveness of the NRC-approved emergency plan. Therefore, we informed your staff of our plans to not accept your application for review.
As a result of our January 7, 2004, discussions with your staff, by letter dated January 16, 2004, you requested to withdraw the changes proposed in your November 25, 2003, letter.
Accordingly, TAC Nos. MC1410 and MC1411 are closed.
