Termination of Actions in the Final Site-Specific ICM Implementation Plan

Dear Sir:

On 03 October 2003, the University of Michigan's Ford Nuclear Reactor provided the Director of Nuclear Security and Incident Response with a schedule for the shipment of the entire inventory of irradiated reactor fuel to the U.S.

Department of Energy's Savannah River Site as required by 10 CFR 73.72. All unirradiated reactor fuel elements were returned to the U.S. Department of Energy on 20 August 2003. A license Amendment eliminating the license conditions B(2) and B(3) for the possession and use of uranium at enrichments equal to or less than 20% and possession of uranium at enrichments greater than 20%, was submitted to the Commission on 27 June 2003 and revised 18 November 2003.

Following the completion of removal of reactor fuel, the facility wvill still possess small quantities of special nuclear material produced by the past operation ofthe facility as contaminants or through activation of impurities. The quantities of these special nuclear materials are small (not exceeding 350 grams of uranium-235, uranium-233, plutonium, or a combination thereof) and are therefore exempt from the security requirements of Part 73, as per Section 73.(c). The licensee believes that no Compensatory Measures for these small quantities of Special Nuclear Material apply or exist.

The University of Michigan will be withdrawving commitments imposed through Confirmatory Action Letter dated 28 October 2003. This is consistent with the Commissions requirements for compensatory measures applying only to research reactors possessing reactor fuel. The University intends to terminate all actions specified in our final site-specific ICM Implementation plan dated 8 October 2003 upon the completion of the last shipment (R28-2003-7) of irradiated reactor elements from the Ford Nuclear Reactor. As required by 10 CFR 73.72, the Ford Nuclear reactor will notify the Commission via the NRC Operations Center of any changes in the schedule for the removal of the irradiated reactor fuel.

I certify that upon the completion of the shipment R28-2003-7, all reactor fuel will have been removed from the Ford Nuclear Reactor. Written certification that all irradiated reactor fuel has been removed from the facility,vill be provided to the Commission immediately upon the completion of shipment R28-2003-7.
