REQUEST FOR CONCURRENCE ON THE DETERMINATION OF EFFECTS ON HISTORIC PROPERTIES FOR THE RENEWAL OF SURRY POWER STATION INDEPENDENT SPENT FUEL STORAGE INSTALLATION

Dear Ms. Kilpatrick:

The U. S. Nuclear Regulatory Commission (NRC) staff is considering amending Virginia Electric and Power Company (Dominion) License No. SNM-2501 to authorize the renewal of the Surry Independent Spent Fuel Storage Installation (ISFSI) located in Surry County, Virginia. By letter dated April 29, 2002, Virginia Electric and Power Company submitted an application for the renewal of the Surry ISFSI License. An applicant for a license of this type must submit an environmental report as part of its application, as required under 10 CFR Part 51 of the NRCs regulations. The NRC staff reviews this information in accordance with the requirements of the National Environmental Policy Act, as specified in 10 CFR 51.10.

In conjunction with its environmental review of Dominions application, the NRC staff has also considered the potential impact of the proposed action on historic properties, in accordance with Section 106 of the National Historic Preservation Act. On October 16, 2003, the NRC staff discussed its assessment of the information regarding historic properties provided in Dominions application with Ms. Ethel Eaton of your staff. After reviewing the potential impacts of the proposed action, we have determined that there are historical properties present in the vicinity of the proposed facility; however, we have concluded that the proposed action will not adversely affect these historic properties.

The basis for reaching this conclusion is that the proposed action is the renewal of an existing facility. There will be construction of a third pad, however, the pad is part of the original design basis. Also a Generic Environmental Impact Statement for License Renewal of Nuclear Plants regarding Surry Power Station, Units 1 and 2 was published in November 2002 (NUREG-1437).

NUREG-1437 concluded that the renewal of the Surry Power Station would not adversely affect these historic properties.

We request your concurrence with this determination that the proposed action will not adversely affect any historical properties. We also request your written reply within 30 days of receipt of this letter, so that we may reference your response in our environmental assessment.
