RULEMAKINGS AND BLUE RIDGE ENVIRONMENTAL DEFENSE LEAGUE'S REQUEST FOR EXTENSION OF TIME TO FILE SUPPLEMENTAL PETITION TO INTERVENE Pursuant to the Atomic Safety and Licensing Board's ("ASLB's") Order (Setting Dedlines, Schedules, and Guidance for Proceedings) (September 23, 2003), Blue Ridge Environmental Defense League ("BREDL") hereby requests an extension of time for filing its amended and supplemental petition to intervene, from October 14 until October 21, 2003. The extension is warranted by the following unavoidable and extreme circumstances: during the week of September 29, BREDL's expert, Dr. Edwin Lyman, is not available to assist BREDL with the preparation of contentions, due to previously made professional commitments to other parties. Dr. Lyman will also be out of town from October 6 until October 14. Therefore BREDL requests an extension of an additional weeks' time, until October 21.
Counsel for BREDL has consulted with counsel for Duke Energy Corporation
("Duke"), who has stated that Duke will oppose the request. Counsel for BREDL attempted to contact counsel for the NRC Staff, but was unsuccessful.
