Dear Mr. Skolds:

The U.S. Nuclear Regulatory Commission (Commission) has issued the enclosed Amendment No. 161 to Facility Operating License No. NPF-11 and Amendment No. 147 to Facility Operating License No. NPF-18 for the LaSalle County Station, Units 1 and 2, respectively. The amendments are in response to your application dated March 31, 2003.

The amendments revise Appendix A, Technical Specifications (TS), of the Facility Operating Licenses. Specifically, the changes revise TS 5.7, "High Radiation Area," by incorporating the wording and requirements from NUREG-1434, "Standard Technical Specifications General Electric Plants, BWR/6," Revision 2, dated June 2001. The revision also includes administrative changes regarding access control and terminology for high radiation areas.

A copy of the Safety Evaluation is also enclosed. The Notice of Issuance will be included in the Commissions biweekly Federal Register notice.

2. Accordingly, the license is amended by changes to the Technical Specifications as indicated in the enclosure to this license amendment and paragraph 2.C.(2) of the Facility Operating License No. NPF-11 is hereby amended to read as follows:

(2) Technical Specifications and Environmental Protection Plan The Technical Specifications contained in Appendix A, as revised through Amendment No. 161, and the Environmental Protection Plan contained in Appendix B, are hereby incorporated in the license. The licensee shall operate the facility in accordance with the Technical Specifications and the Environmental Protection Plan.

3. This license amendment is effective as of the date of its issuance and shall be implemented within 60 days of the date of issuance.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 161 TO FACILITY OPERATING LICENSE NO. NPF-11 AND AMENDMENT NO. 147 TO FACILITY OPERATING LICENSE NO. NPF-18 EXELON GENERATION COMPANY, LLC LASALLE COUNTY STATION, UNITS 1 AND 2 DOCKET NOS. 50-373 AND 50-374

1.0 INTRODUCTION

By application dated March 31, 2003 (Ref. 1), Exelon Generation Company, LLC (the licensee),

requested changes to the Technical Specifications (TS) for LaSalle County Station, Units 1 and 2. Specifically, the proposed changes would revise TS 5.7, "High Radiation Area," by incorporating the wording and requirements from NUREG-1434, "Standard Technical Specifications General Electric Plants, BWR/6," Revision 2, dated June 2001. The proposed revision also includes administrative changes regarding access control and terminology for high radiation areas.

2.0 REGULATORY EVALUATION

The regulatory documents reviewed by the staff are listed below:

3.0 TECHNICAL EVALUATION

The staff has reviewed the licensees regulatory and technical analyses in support of its proposed license amendment which are described in Attachment 2 of the licensees submittal.

The detailed evaluation below will support the conclusion that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendment will not be inimical to the common defense and security or to the health and safety of the public.

The licensee proposed to modify their existing TS 5.7, "High Radiation Area," by incorporating the wording and requirements of NUREG-1434. In addition to the requirements of 10 CFR 20.1601, 10 CFR 20.1602 requires that licensees shall institute additional measures to ensure that an individual is not able to gain access to areas where radiation levels could equal 500 rads or more in one hour at one meter. LaSalles existing TS 5.7 describes personnel access controls for entering high radiation areas having dose rates between 100 and 1000 millirem per

hour (mrem/hr) and a second set of access controls for persons entering high radiation areas having dose rates greater than 1000 mrem/hr. However, by not putting an upper dose rate limit of 500 rads per hour (rads/hr) on this second set of access controls for areas having dose rates greater than 1000 mrem/hr, the existing TS 5.7 implies that there is no upper dose limit above which additional personnel access controls would apply. The proposed incorporation of the wording and requirements of NUREG-1434 into TS 5.7 resolves this issue by providing an upper limit of 500 rads/hr on the second set of personnel access controls and makes it the licensees responsibility to institute the additional measures to control personnel access to areas where the radiation levels could equal 500 rads/hr or more per the requirements of 10 CFR 20.1602. Since this proposed change is in accordance with NUREG-1434, Regulatory Guide 8.38, and the requirements of 10 CFR 20.1601 and 10 CFR 20.1602, the staff finds this proposed change to TS 5.7 to be acceptable.

The proposed change also replaces reference to the use of computer controlled doors which are no longer utilized at LaSalle County Station with reference to the use of doors with manual locking mechanisms. Since these doors having manual locking mechanisms provide an equivalent level of access control as the previously used computer controlled doors, the staff finds this change to be acceptable. The staff also finds acceptable the administrative change of deleting reference to the outdated term "high-high" radiation areas from TS 5.7.

4.0 STATE CONSULTATION

In accordance with the Commission's regulations, the Illinois State official was notified of the proposed issuance of the amendments. The State official had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

The amendments change a requirement with respect to the installation or use of a facility component located within the restricted area as defined in 10 CFR Part 20. The NRC staff has determined that the amendments involve no significant increase in the amounts, and no significant change in the types, of any effluents that may be released offsite, and that there is no significant increase in individual or cumulative occupational radiation exposure. The Commission has previously issued a proposed finding that the amendments involve no significant hazards consideration, and there has been no public comment on such finding (68 FR 28852). Accordingly, the amendments meet the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(9). Pursuant to 10 CFR 51.22(b), no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
