rxi 7 REIFinal Environmental Impact Statement for GENERIC - Fort Calhoun Station Unit 1, Renewal of the Operating Licenses (OLs) for an Additional 20 Years, Supplement 12 (NUREG-1437) Omaha Public Power District (OPPD), Washington County, Nebraska

Dear Mr. Cushing:

The Environmental Protection Agency (EPA) has reviewed the Final Environmental Impact Statement (FEIS) for the subject re-licensing action. Our review is provided pursuant to the National Environmental-Policy Act (NEPA) 42 U.S.C. 4231, Council on Environmental Quality (CEQ) regulations 40 C.F.R. Parts 1500-1508, and Section 309 of the Clean Air Act (CAA). The Final EIS was assigned a CEQ number of 030381. The FEIS adequately addresses issues raised by EPA in the review of the DEIS for this action,: therefore, EPA has no objections to the re-licensing action as described in the FEIS.

Recent discussions between Fish and Wildlife Service, Omaha Public Power District and EPA on a range of potential revisions being considered for Section 316 of the Clean Water Act (CWA) (impingement/entrainment) were advisory in nature. Regardless of conservation measures implemented prior to CWA Section 316 revision, OPPD will be responsible for compliance with the final rule.

If you have any questions, please contact me at (913) 551-7148.

Sincerely, -

Joseph E. Cothern
