Dear Mr. Cushing:
The Environmental Protection Agency (EPA) has reviewed the Final Environmental Impact Statement (FEIS) for the subject re-licensing action. Our review is provided pursuant to the National Environmental-Policy Act (NEPA) 42 U.S.C. 4231, Council on Environmental Quality (CEQ) regulations 40 C.F.R. Parts 1500-1508, and Section 309 of the Clean Air Act (CAA). The Final EIS was assigned a CEQ number of 030381. The FEIS adequately addresses issues raised by EPA in the review of the DEIS for this action,: therefore, EPA has no objections to the re-licensing action as described in the FEIS.
Recent discussions between Fish and Wildlife Service, Omaha Public Power District and EPA on a range of potential revisions being considered for Section 316 of the Clean Water Act (CWA) (impingement/entrainment) were advisory in nature. Regardless of conservation measures implemented prior to CWA Section 316 revision, OPPD will be responsible for compliance with the final rule.
