September 5, 2003 Mr. Roger W. Fones Chief, Transportation, Energy and Agriculture Section Antitrust Division Department of Justice 325 7th Street N.W., Suite 500 Washington, DC 20530

SUBJECT:

SOUTH TEXAS PROJECT, UNITS 1 AND 2 - CONSIDERATION OF AMENDMENT REGARDING ANTITRUST LICENSE CONDITIONS (TAC NOS. MB6169 AND MB6170)

Dear Mr. Fones:

The U. S. Nuclear Regulatory Commission is considering issuing amendments to Facility Operating License Nos. NPF-76 and NPF-80 for South Texas Project, Units 1 and 2, respectively. The proposed amendments would delete the antitrust conditions of the licenses in response to the licensees application dated August 20, 2002. A copy of the application (identifying the conditions to be deleted) was transmitted separately to Ms. Janet Urban.

We request that your office provide Department of Justice comments to the NRC no later than October 15, 2003. If you have any questions, please contact me at 301-415-1439.

Sincerely,

/RA/

David H. Jaffe, Senior Project Manager, Section 1 Project Directorate IV Division of Licensing Project Management Office of Nuclear Reactor Regulation Docket Nos. 50-498 and 50-499 cc: See next page
