SUBJECT: MID-CYCLE ASSESSMENT LETTER - DRESDEN NUCLEAR POWER

STATION (REPORT 50-237/04-01; 50-249/04-01)

Dear Mr. Skolds:

On July 30, 2003, the NRC staff completed its mid-cycle plant performance assessment of the

Dresden Nuclear Power Station. The mid-cycle review involved the participation of all technical

divisions in evaluating performance indicators (PIs) for the most recent quarter and inspection

results for the first half of the current assessment cycle, January 1, 2003 - December 31, 2003.

The purpose of this letter is to inform you of our assessment of your safety performance during

this period and our plans for future inspections at your facility so that you will have an

opportunity to prepare for these inspections and to inform us of any planned inspections that

may conflict with your plant activities.

Plant performance for the most recent quarter for Dresden Unit 3 continued to be within the

Regulatory Response Column of the NRCs Action Matrix, based on the White Unit 3 high

pressure coolant injection (HPCI) safety system unavailability PI in the mitigating system

cornerstone. This PI went White in the third quarter of 2001 due to the fault exposure hours

following the Unit 3 HPCI water hammer event on July 5, 2001. As a result of the White PI, a

supplemental inspection conducted in accordance with Inspection Procedure 95001 is

scheduled for November 2003.

Additionally, by letter dated June 23, 2003, the staff issued a Severity Level III Notice of

Violation of 10 CFR 50.9 in accordance with the enforcement policy. The violation was for

incomplete and inaccurate information provided to the NRC on September 27, 2001, that was

material to the NRC because the NRC staff was evaluating the operability determination for the

Dresden, Unit 3, HPCI system. A White finding was also issued with the same letter for

inadequate corrective actions when the HPCI water hammer was initially identified. The

supplemental inspection mentioned above for the White performance indicator will include the

White finding for inadequate corrective action and the 50.9 violation.

With respect to Unit 2, plant performance for the most recent quarter was within the Licensee

Response Column of the NRCs Action Matrix, based on all inspection findings being classified

as having very low safety significance (Green) and all PIs indicating performance at a level

requiring no additional NRC oversight (Green). Therefore, we plan to conduct only baseline

inspections for Unit 2 through September 30, 2004.

The inspection plan is provided to minimize the resource impact on your staff and to allow for

scheduling conflicts and personnel availability to be resolved in advance of inspector arrival

onsite. Routine resident inspections are not listed due to their ongoing and continuous nature.

The inspections in the last 6 months of the inspection plan are tentative and may be revised at

the end-of-cycle review meeting.

In accordance with 10 CFR 2.790 of the NRCs Rules of Practice, a copy of this letter and its

enclosure will be made available electronically for public inspection in the NRC Public

Document Room or from the Publicly Available Records (PARS) component of NRC's

document system (ADAMS). ADAMS is accessible from the NRC Web site at
