Ladies and Gentlemen:

On May 14, 2003, the FirstEnergy Nuclear Operating Company (FENOC) submitted an application for an amendment to the Davis-Besse Nuclear Power Station, Unit Number 1 (DBNPS) Operating License NPF-3, Appendix A Technical Specifications, regarding Technical Specification (TS) 3/4.5.2, Emergency Core Cooling Systems - ECCS Subsystems - Tavg

> 280'F. The proposed amendment (DBNPS letter Serial Number 2950) would add an exception applicable only during the Mode 3 (Hot Standby) Restart Test Plan normal operating pressure inspection activities conducted during the ongoing thirteenth refueling outage (13RFO).

Supplemental information supporting the proposed application for amendment was provided by FENOC letter Serial Number 2980, dated August 2, 2003, in response to an NRC Request for Additional Information dated July 31, 2003 (FENOC Log Number 6105).

On August 15, 2003, the NRC and FENOC held a telephone call to clarify FENOC commitments contained in both the May 14, 2003, and August 2, 2003, submittals. During the call, FENOC provided the following additional commitment:

The existing Emergency Operating Procedures (EOPs) will be modified to cover potential depressurization operations applicable to the proposed Mode 3 test and a new EOP attachment will be written that is referenced in the EOP modifications.

Docket Number 50-346 License Number NPF-3 Serial Number 2984 Page 2 These EOPs will be verified to be correct and will be in the control room and the Technical Support Center (TSC) prior to entry into Mode 4 under the proposed exception.

This submittal documents the commitment made by FENOC during the August 15, 2003 telephone call. With the providing of this additional information, FENOC requests that the NRC staff complete its review of this license amendment application and issue the license amendment by August 27, 2003.

The information provided in this submittal does not affect the conclusions stated in the previously submitted license amendment application that there is no adverse impact on nuclear safety and that the proposed amendment involves no significant hazards consideration.
