In response to an allegation electronically submitted by David Lochbaum of the Union of Concerned Scientists on August 5, 2003, to Mr. John Grobe, Chairman of the Davis-Besse 0350 Oversight Panel, the FirstEnergy Nuclear Operating Company (FENOC) is submitting the enclosed statement under Oath and Affirmation. This submittal validates the signature of Mr.
Lew Myers, FENOC Chief Operating Officer as it appears in the August 2, 2003 docketed submittal, entitled "Supplemental Information Regarding License Amendment Application to Revise Technical Specification (TS) 3/4 5.2 Emergency Core Cooling Systems -
ECCS Subsystems - T avg > 280° F (License Amendment Request No. 03-0008; TAC No. MB 8953)".
I trust that this information resolves Mr. Lochbaum's unsubstantiated allegation regarding the authenticity of Mr. Myers' signatures on the transmittal letter and the Oath and Affirmation page of the August 2, 2003 submittal.
