SUBJECT:
RESPONSE TO PUBLIC CITIZEN AND NCWARN LETTER TO NORTH CAROLINA ATTORNEY GENERAL Public Citizen and the North Carolina Waste Awareness and Reduction Network (NCWARN) sent a letter dated August 6, 2003, to North Carolina Attorney General Roy Cooper concerning a spent fuel cask surface contamination incident involving a shipment from the H.B. Robinson Nuclear Plant to the Shearon Harris Nuclear Plant on July 29, 2003. The Public Citizen and NCWARN letter asked several questions concerning this and similar shipments, and stated that the shipments to Harris represent an unacceptable risk, and requested a reply to these urgent health and safety concerns.
Commissioner McGaffigan provided staff with a draft response letter to the Public Citizen and NCWARN letter that dispels the notion that the incident involves a health and safety issue.
Staff has revised this letter (Attachment 1) and proposes to dispatch it unless directed otherwise.
In a related matter, Region II is following-up on an allegation related to the conduct of surveys for the shipment from H.B. Robinson.
