SOUTH TEXAS PROJECT, UNITS 1 AND 2 - WITHDRAWAL OF AMENDMENT REQUEST (TAC NOS. MB4059 AND MB4060)

Dear Mr. Sheppard:

By letter dated February 14, 2002, and its supplement dated January 7, 2003, you applied for an amendment to Facility Operating Licenses Nos. NPF-76 and NPF-80 for the South Texas Project (STP), Units 1 and 2, respectively. The proposed change would have modified STP, Units 1 and 2, Technical Specifications pertaining to reactor coolant system leakage detection.

Subsequently, by letter dated May 22, 2003, you requested to withdraw the amendment request; the NRC staff did not have any objections to your request to withdraw the amendment request.

Since the amendment request has been withdrawn, the Commission has filed the enclosed Notice of Withdrawal of Application for Amendment to Facility Operating License with the Office of the Federal Register for publication.

7590-01-P UNITED STATES NUCLEAR REGULATORY COMMISSION STP NUCLEAR OPERATING COMPANY DOCKET NOS. 50-498 AND 50-499 NOTICE OF WITHDRAWAL OF APPLICATION FOR AMENDMENT TO FACILITY OPERATING LICENSES The U.S. Nuclear Regulatory Commission (the Commission) has granted the request of STP Nuclear Operating Company (the licensee) to withdraw its February 14, 2002, and its supplement dated January 7, 2003, applications for proposed amendments to Facility Operating Licenses No. NPF-76 and No. NPF-80 for the South Texas Project, Units 1 and 2, located in Matagorda County, Texas.

The Commission had previously issued a Notice of Consideration of Issuance of Amendment published in the Federal Register on April 2, 2002, (67 FR 15629) . However, by letter dated May 22, 2003, the licensee withdrew the proposed change.

For further details with respect to this action, see the application for amendment dated February 14, 2002, and its supplement dated January 7, 2003, and the licensees letter dated May 22, 2003, which withdrew the application for license amendment.
