Dear Senator Edwards:
For your Information, I have enclosed several recent U.S. Nuclear Regulatory Commission (NRC) adjudicatory decisions which conclude that the National Environmental Policy Act (NEPA) does not require the consideration of the impacts of terrorism. These decisions were the subject of a January 7, 2003 article Inthe New York Times.
As the decisions make clear, they do not Inany way reflect a Commission decision that terrorism Issues should be Ignored. On the contrary, the Commission has and will continue to devote considerable attention to this Issue. The decisions simply reflect the conclusion that a NEPA analysis need not encompass the matter.
