Dear Mr. Morey:

The Nuclear Regulatory Commission has issued the enclosed Amendment No. 160 to Facility Operating License No. NPF-2 and Amendment No. 152 to Facility Operating License No. NPF-8 for the Joseph M. Farley Nuclear Plant, Units 1 and 2. The amendments consists of a change to the Technical Specifications (TS) in response to your application dated March 21, 2003.

The amendments revise TS Section 5.5.1 Offsite Dose Calculation Manual (ODCM). The proposed change will remove reference to the Plant Operations Review Committee review and acceptance of licensee initiated changes to the ODCM. The NRC staff has completed its review of your submittal and has concluded that the proposed TS change is acceptable.

A copy of the related Safety Evaluation is also enclosed. A Notice of Issuance will be included in the Commission's biweekly Federal Register notice.

1. The Nuclear Regulatory Commission (the Commission) has found that:

A. The application for amendment by Southern Nuclear Operating Company, Inc.

(Southern Nuclear), dated March 21, 2003, complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commissions rules and regulations set forth in 10 CFR Chapter I; B. The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations; D. The issuance of this license amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.

2. Accordingly, the license is amended by changes to the Technical Specifications, as indicated in the attachment to this license amendment; and paragraph 2.C.(2) of Facility Operating License No. NPF-2 is hereby amended to read as follows:

(2) Technical Specifications The Technical Specifications contained in Appendices A and B, as revised through Amendment No. 160, are hereby incorporated in the license. Southern Nuclear shall operate the facility in accordance with the Technical Specifications.

3. This license amendment is effective as of its date of issuance and shall be implemented within 30 days of issuance.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 160 TO FACILITY OPERATING LICENSE NO. NPF-2 AND AMENDMENT NO. 152 TO FACILITY OPERATING LICENSE NO. NPF-8 SOUTHERN NUCLEAR OPERATING COMPANY, INC., ET AL.

JOSEPH M. FARLEY NUCLEAR PLANT, UNITS 1 AND 2 DOCKET NOS. 50-348 AND 50-364

1.0 INTRODUCTION

By letter dated March 21, 2003, the Southern Nuclear Operating Company, Inc. (SNC) et al.,

submitted a request for a change to the Joseph M. Farley Nuclear Plant (FNP), Units 1 and 2, Technical Specifications (TS). The requested change would revise TS 5.5.1, Offsite Dose Calculation Manual (ODCM). Specifically, it would remove reference to the Plant Operations Review Committee (PORC) review and acceptance of licensee initiated changes to the ODCM.

This proposed change was overlooked during the conversion of FNP TS to Improved Standard Technical Specifications (ISTS). The licensees intent for this proposed change is to enhance consistency with the ISTS and SNC sister plants, Hatch and Vogtle.

2.0 REGULATORY EVALUATION

The proposed TS change was submitted in accordance with Title 10 of the Code of Federal Regulations (10 CFR) Section 50.90. The proposed change would remove reference to the PORC that is now known as the Plant Review Board (PRB) and is defined in Chapter 17 of the FNP Updated Final Safety Analysis Report (UFSAR) as part of FNP Quality Assurance (QA)

Program. The PORC/PRB is responsible for reviewing all changes to the OCDM. Changes to the QA program in UFSAR Chapter 17 are governed by 10 CFR 50.54(a).

3.0 TECHNICAL EVALUATION

TS 5.5.1.b currently states that licensee initiated changes to the ODCM shall become effective after review and acceptance by PORC and the approval of the General Manager-Nuclear Plant. After the change, TS 5.5.1.b would state that such changes, shall become effective after the approval of the General Manager-Nuclear Plant. The wording of TS 5.5.1 after the change is consistent with the Nuclear Regulatory Commission (NRC) document NUREG-1431, Standard Technical Specifications - Westinghouse Plants. This change does not reduce the review responsibilities of the PORC/PRB as defined in the FNP UFSAR Chapter 17 as part of the FNP QA Program. Since this change does not affect the function or the scope of the PORCs responsibility that is described in the QA Program in the UFSAR, the NRC staff concludes that the proposed change is acceptable.

4.0 STATE CONSULTATION

In accordance with the Commissions regulations, the State of Alabama official was notified of the proposed issuance of the amendments. The State official had no comments.

5.0 ENVIRONMENTAL CONSIDERATION

The amendments relate to changes in recordkeeping, reporting, or administrative procedures or requirements. Accordingly, the amendment meets the eligibility criteria for categorical exclusion set forth in 10 CFR 51.22(c)(10). Pursuant to 10 CFR 51.22(b) no environmental impact statement or environmental assessment need be prepared in connection with the issuance of the amendments.

6.0 CONCLUSION

The Commission has concluded, based on the considerations discussed above, that (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commissions regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
