In accordance with 10 C.F.R. § 50.4, Duke Energy Corporation ("Duke") hereby submits its response to the March 20, 2003, Request For Additional Information ("RIA") regarding Duke's response to the Order For Compensatory Measures Related To Access Authorization ("Order") issued by the United States Nuclear Regulatory Commission ("NRC") on January 7, 2003. The purpose of this response is to provide clarification regarding Duke's compliance with the Order's compensatory measure B.1.3(c).
This response provides clarification as requested without modifying or changing the remaining aspects of Duke's January 22, 2003 response.
In the January 22, 2003 response, in describing Duke's contemplated action, Duke quoted compensatory measure B.1.3(c), stating that it would complete the required inquires to the "fullest extent possible."
A more accurate statement of Duke's contemplated action as it relates to compensatory measure B.1.3(c) and the appropriate quote from the Order is that Duke will complete the required inquiries "to the extent possible." That is, Duke will confirm eligibility for employment to the extent achievable in accordance with the requirements of the 1-9 process, "Employment Eligibility Verification," from the Bureau of Citizenship and Immigration Service (formerly INS), United States Department Of Homeland Security.
